1 This is an appeal from a conviction in the District Court, Stephens County, Oklahoma, Case No. CRF-74-27, in which appellant, Joe Mansfield Pollard, was convicted for the offense of Burglary, Second Degree, After Former Conviction of a Felony. Appellant was tried by a jury in a two-stage proceeding, after which the jury assessed appellants punishment at ten (10) years imprisonment. From that judgment and sentence the appellant has perfected his appeal to this Court. The appellant will hereinafter be referred to as defendant, as he appeared in the trial court.
